1. Introduction:

Welcome to the Easy Jazz app. These Terms and Conditions govern your access to and use of our network websites, online content, and mobile app (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and Conditions.

We may update these Terms and Conditions from time to time. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms and Conditions. 

2. Intellectual Property:

All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, and software, is the intellectual property of Easy Jazz FM, the Easy Jazz Network and the ownership company, Galbraith Communications. 

You may not copy, modify, distribute, or otherwise exploit any content on the Platform without our express written permission. 

3. Copyright Material:

All music on the five stations of the Easy Jazz Network are copywritten. Galbraith Communications has obtained the necessary licensing for public broadcasting of copywritten music. You are free to listen to our stations, but recording our music for playback in a public venue is prohibited. 

4. User Contributions:

You may be able to submit user-generated content to the Platform, such as comments, reviews, or other feedback. By submitting such content, you grant us a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your content. We are not responsible for any user-generated content and do not endorse any views or opinions expressed in such content. 

5. Acceptable Use:

You agree to use the Platform only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to use the Platform to:
Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable. Engage in any activity that violates the rights of others, including but not limited to copyright, trademark, or privacy rights. Collect or store any personally identifiable information about other users without their consent. Distribute any viruses or other malicious software. 

6. Prohibited Activities:

You are prohibited from engaging in any of the following activities: Attempting to gain unauthorized access to the Platform or its systems. Interfering with or disrupting the operation of the Platform. Bypassing any security measures or restrictions on the Platform. Engaging in any activity that violates the rights of others. 

7. Disclaimers:

The Platform is provided "as is" and without any warranties, expressed or implied. We do not warrant that the Platform will be free from errors or interruptions. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 

8. Limitation of Liability:

In no event shall the Easy Jazz Network be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. Our liability shall be limited to the maximum extent permitted by applicable law. 

9. Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles.
